Since September 11, 2001, the United States has tightened the availability of visas to foreign persons entering the country and real estate buyers must be aware of this. The type of visa a person can acquire depends on factors, such as length of stay, reason for visit, and other requirements.  

Given the U.S. visa and residence limitations on the length of time that foreign buyers may be able to personally make use of their property, many buyers are opting to purchase a home or condominium for dual use to be enjoyed by the buyer as well as a rental property.  The majority of the foreign buyers who buy in the Naples Florida area opt to enjoy their property for a 3 to 6 month use and some slightly less.

There are very few restrictions for foreign buyers of U.S. real estate with the exception of national security issues. A foreign buyer of Florida real estate can take title to real estate in their own name, in the name of a domestic or foreign corporation, a limited partnership, a limited liability company, a joint venture, a real estate investments trust (REIT), or a foreign pension plan. A real estate buyer may acquire, transfer and be involved in any real estate transaction without express permission or approval from any federal, state or local government entity. However, compliance with visa requirements, transfer of funds and tax issues must be complied with.

There are over 40 types of non-immigrant visas available and foreign buyers should consult with professional legal counsel on these matters. Many buyers of real estate in the U.S. opt for the type that best fits their goals, and there are a variety of visa types available for such purposes. 

As an investor or property manager who may wish to remain longer in the U.S., there are options that will cost more, but will allow for a legal stay that may allow a person to remain for years. Oftentimes this is accomplished through a direct investment in a U.S. firm or a local subsidy of a foreign company. There are a variety of business visa options, including the popular EB-5 visa and E-2 visa.
